Terms of Use
Last updated: April 1, 2026
These Terms of Use ("Terms") govern your access to and use of the SeaLink.cloud vessel monitoring platform ("Service") operated by SeaLink.cloud ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
SeaLink.cloud is a cloud-based vessel monitoring platform that receives NMEA instrument data from your onboard SignalK server and presents it via a web dashboard. Features include real-time sensor display, GPS tracking, anchor alarms, custom alert rules, tide predictions, polar performance analytics, time-series charts, and data export.
2. Not a Safety System
SeaLink.cloud is an informational tool only. It is not a certified safety system, navigation aid, or substitute for proper seamanship, watchkeeping, or maritime safety equipment. You must not rely on SeaLink.cloud as your sole means of monitoring vessel safety. Anchor alarms, custom alerts, and tide predictions are provided for convenience and may be delayed, inaccurate, or unavailable due to connectivity, sensor, or software issues. Always maintain proper watch and carry appropriate safety equipment aboard your vessel.
3. Account Responsibilities
- You must provide a valid email address and create a secure password (minimum 8 characters with uppercase, digit, and special character).
- You are responsible for maintaining the confidentiality of your account credentials and your vessel's Device Key.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at hello@sealink.cloud if you suspect unauthorized access to your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to other users' accounts, vessels, or data
- Submit false, misleading, or fraudulent data to the platform
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Reverse-engineer, decompile, or disassemble the Service (the SignalK plugin is open source under its own license)
- Exceed reasonable API usage rates or submit data designed to overload the system
- Use the Service to track vessels without the knowledge and consent of the vessel owner
5. Beta Service
SeaLink.cloud is currently in beta. During the beta period:
- The Service is provided free of charge with no commitment to maintain pricing after beta ends
- Features may be added, changed, or removed without prior notice
- Service interruptions may occur for maintenance, updates, or unforeseen issues
- We may limit the number of vessels, data points, or alert rules per account
- We reserve the right to end the beta period and transition to paid plans with reasonable notice
6. Data Ownership
You retain ownership of all vessel sensor data, GPS positions, and other information you transmit to SeaLink.cloud. We claim no ownership rights over your data. We use your data solely to provide and improve the Service as described in our Privacy Policy.
You grant us a limited license to process, store, and display your data as necessary to operate the Service, including generating derived analytics (polar performance, tide predictions, alert evaluations).
7. API Usage
SeaLink.cloud provides a RESTful API and WebSocket (SignalR) interface. API access is subject to rate limiting. We reserve the right to throttle or suspend API access if usage patterns are abusive or negatively impact other users. Public API endpoints are available for vessels with public tracking enabled.
8. Multi-Crew Access
Vessel owners may invite crew members with role-based access. The vessel owner is responsible for managing crew permissions and assumes responsibility for crew members' use of the Service in connection with their vessel.
9. SMS & Email Notifications
By providing your phone number and enabling SMS alerts, you consent to receive automated text messages from SeaLink.cloud for anchor alarms and custom alert notifications. Standard messaging rates from your carrier may apply. You can disable SMS notifications at any time in your dashboard settings.
By creating an account, you consent to receive transactional emails related to your account and alerts. We do not send marketing emails without your explicit opt-in.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service, particularly during the beta period. The Service depends on internet connectivity between your vessel and our servers. We are not responsible for data loss or missed alerts due to:
- Loss of internet connectivity on your vessel
- SignalK server or NMEA instrument failures
- Planned or unplanned maintenance windows
- Third-party service outages (SMS delivery, email delivery, cloud infrastructure)
- Force majeure events
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEALINK.CLOUD AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: DAMAGE TO YOUR VESSEL, LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR ANY DAMAGES ARISING FROM RELIANCE ON THE SERVICE'S ALERTS, PREDICTIONS, OR ANALYTICS.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim (which, during beta, is $0).
12. Indemnification
You agree to indemnify and hold harmless SeaLink.cloud and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
You may delete your account at any time by contacting us at hello@sealink.cloud. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
14. Changes to These Terms
We may modify these Terms at any time. We will notify registered users of material changes via email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of British Columbia, Canada.
